AirPay is a proprietary digital payment and merchant aggregator brand operated under LinkIT360. Below is our full legal, privacy, and compliance framework governing the use of our platform.

Proprietary Rights & Corporate Structure

All material on the AirPay website (the “Site”), including without limitation all informational text, corporate graphics, processing interfaces, compliance documentation, software, and code (collectively, the “Materials”), is owned and protected under the global corporate infrastructure of LinkIT360(hereafter referred to as “LinkIT360”, “We”, “Us”, or “AirPay”).

These Materials are protected by copyright, trademark, and intellectual property laws across Indonesia and international jurisdictions. You are strictly prohibited from copying, modifying, or distributing any Materials without prior written consent from LinkIT360.

Disclaimer of Warranties & Limitation of Liability

The AirPay platform and services are provided on an “AS IS” and “AS AVAILABLE” basis. All warranties, express or implied — including implied warranties of merchantability, security compliance, and fitness for a particular purpose — are explicitly disclaimed.

In no event shall AirPay or LinkIT360 be liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of revenue, profit, data, or transaction failure, arising from unexpected system downtime, software errors, or circumstances beyond our control.

Privacy & Data Protection Policy (Indonesia & Global Merchant Scope)

At AirPay, operated under the corporate umbrella of LinkIT360, your data security and privacy are non-negotiable compliance priorities. We operate in strict alignment with Indonesian Law No. 27/2022 on Personal Data Protection (UU PDP) and recognized global data protection standards governing international cross-border commerce.

  • Scope of Data Collection: To execute our duties as a merchant aggregator, We collect and process two distinct layers of data: Merchant Data — corporate KYB documentation, Ultimate Beneficial Owner (UBO) identification, and corporate bank routing credentials; and End-User Transaction Data — transaction values, payment methods, and basic identification strings forwarded by our merchants for payment processing.
  • Authorized Data Sharing and Financial Routing: We do not sell or exchange personal or corporate data with third-party marketers. However, as an active payment and merchant aggregator, you explicitly authorize AirPay to share required transaction and compliance data with partner acquiring banks, payment switch networks, and clearing houses to process, settle, and clear funds.
  • Cross-Border Data Transfers: To facilitate international multi-currency processing, data collected under this framework may be securely transferred, stored, and routed across global servers. AirPay enforces encryption and standard protection clauses to ensure all cross-border data movements comply with applicable national and international regulations.
  • Regulatory Data Retention Override: In accordance with global Anti-Money Laundering (AML), Counter-Terrorism Financing (CFT), and applicable central bank regulations (including Bank Indonesia mandates), corporate, identity, and transactional records will be securely retained for a mandatory minimum period of five (5) years. This legal obligation supersedes standard data deletion or erasure requests.
  • Data Security Commitment: AirPay implements strict logical access controls, industry-standard encryption protocols, and adheres to global security guidelines required for secure financial transaction processing.

Acceptable Use Policy (AUP)

As a merchant aggregator, AirPay maintains strict adherence to global financial safety rails. All merchants onboarding with AirPay must comply with this Acceptable Use Policy.

Prohibited Businesses (Strictly Disallowed)

  • Illegal narcotics, prescription drugs without license.
  • Unlicensed gambling, betting, or casinos.
  • Weapons, ammunition, and fireworks.
  • Ponzi schemes, multi-level marketing (MLM) without clear products.
  • Counterfeit goods or intellectual property infringement.

Restricted Businesses (Requires Prior Approval)

  • Financial services, remittance, and cryptocurrency exchanges.
  • Telecommunications and calling cards.
  • High-value luxury goods and collectibles.
  • Travel agencies and timeshare services.
  • Licensed pharmaceuticals and health supplements.

AirPay reserves the right to immediately terminate any merchant account found violating this AUP without prior notice.

Dispute, Refund, and Chargeback Policy

AirPay operates strictly as a payment and merchant aggregator connecting businesses to financial networks.

  • Product/Service Liability: AirPay does not buy, sell, or exercise operational control over the goods or services sold by our onboarded merchants. Any disputes regarding quality, delivery failures, or merchant performance must be resolved directly between the end-user and the merchant.
  • Settlement Freezes & Fraud Triggers: AirPay reserves the right to immediately execute temporary settlement freezes or place funds in a rolling reserve if a merchant account exhibits high chargeback ratios, unusual transaction spikes, or clear indicators of fraud.
  • Chargeback Financial Indemnity: The merchant bears full financial liability for all chargebacks, reversed transactions, or associated bank penalties. Merchants agree to fully indemnify AirPay and LinkIT360 against any financial losses stemming from disputes or cardholder reversals.

Anti-Money Laundering (AML) & Counter-Terrorism Financing (CFT) Statement

AirPay is committed to maintaining an institutional-grade compliance infrastructure to counter financial crimes. We conduct continuous transaction monitoring, strict Know Your Business (KYB) verifications, and sanction screening. AirPay complies fully with national financial intelligence mandates and international standards. Suspicious transaction patterns will be reported to the appropriate financial regulatory authorities without tipping off the offending parties.

Consumer Grievance Redressal & Contact SLA

We value transparency and consumer protection. If you are a consumer experiencing transaction issues, or if you believe a merchant using AirPay rails is engaging in fraudulent activities, you may file an official report.

  • Service Level Agreement (SLA): Our teams and support desk will acknowledge and review all submitted complaints within forty-eight (48) business hours from receipt.

E-mail Disclaimer

All electronic correspondence from AirPay is intended exclusively for the addressed recipient and may contain confidential, privileged, or proprietary information. Any unauthorized dissemination or replication is strictly prohibited. Sentiments expressed in individual emails do not automatically constitute an official corporate commitment by AirPay unless validated by an authorized executive.

Terms and Conditions (Terms of Service)

Welcome to AirPay. By accessing our Site, registering an account, or utilizing our merchant aggregator services, you (“The Merchant”, “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must immediately cease all use of our platform.

9.1. Scope of Services & Regulatory Status

  • Aggregator Role: AirPay operates strictly as a technical and commercial payment aggregator infrastructure under LinkIT360. We facilitate the routing and processing of transactions from various payment methods (credit cards, e-wallets, bank transfers) to the Merchant's account via licensed acquiring banks and payment networks.
  • Pure Pass-Through Infrastructure: AirPay is a pure Pass-Through system. AirPay does not hold, store, or manage pre-funded customer deposits, digital wallet balances, or execute deposit-taking activities.
  • No Banking/E-Money Liabilities: The Merchant acknowledges that AirPay is not a bank, financial institution, or e-money issuer. All funds processed are routed directly to licensed clearing networks and settled to the Merchant's designated corporate bank account based on the agreed settlement schedule.

9.2. Account Registration, KYB, and Security

  • Veracity of Information: To activate AirPay services, the Merchant must complete our digital onboarding process and provide accurate, current, and verifiable Know Your Business (KYB) documentation as outlined in our Verification Checklist.
  • Continuous Updates: The Merchant is legally obligated to update AirPay immediately of any changes to its corporate structure, ultimate beneficial ownership (UBO), business model, bank routing details, or licensing status.
  • Credential Security: The Merchant bears sole responsibility for maintaining the confidentiality of API keys, account passwords, and dashboard login credentials. AirPay shall not be held liable for any financial losses resulting from unauthorized access due to the Merchant's negligence.

9.3. Fees, Settlements, and Taxes

  • Merchant Discount Rate (MDR): All transactions processed through AirPay are subject to processing fees, operational margins, or MDR as defined in the commercial agreement or digital onboarding rate card. AirPay reserves the right to deduct these fees automatically from the gross transaction value prior to final settlement.
  • Settlement Timing: Settlements will be executed according to the standard schedule (e.g., T+2, T+3) agreed upon during activation. AirPay is not responsible for settlement delays caused by third-party banking networks, clearinghouse backlogs, or technical failures on the receiving bank's end.
  • Tax Compliance: Each party is independently responsible for identifying, declaring, and paying all taxes, levies, or duties imposed by relevant financial authorities (including Indonesian PPN/PPh frameworks and global digital service tax mandates) applicable to their respective revenue streams.

9.4. Merchant Operational Obligations & Data Security

  • Lawful Conduct: The Merchant warrants that it will operate its business in strict compliance with applicable local and international laws and will not engage in any activities prohibited by our Acceptable Use Policy (AUP).
  • Customer Security Standards: The Merchant must secure its own digital environment. If the Merchant collects, stores, or transmits end-user cardholder data or sensitive payment tokens, it must strictly adhere to global security protocols and prevent data skimming or data leaks.

9.5. Account Suspension and Immediate Termination

Right to Freeze: AirPay reserves the absolute right to temporarily freeze settlements or permanently suspend a Merchant account without prior notice if:

  • The Merchant violates any provision of these Terms or the AUP.
  • The Merchant is flagged by automated systems or partner banks for unusually high fraud or chargeback volumes.
  • AirPay detects suspicious transaction patterns that trigger global Anti-Money Laundering (AML) or Counter-Terrorism Financing (CFT) redlines.

Effect of Termination: Upon account termination, all technical API accesses will be revoked. Any remaining cleared funds held in the settlement pipeline will be paid out to the Merchant after deducting applicable chargebacks, fines, or operational fees, unless frozen by a valid regulatory or law enforcement court order.

9.6. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the Laws of the Republic of Indonesia, without giving effect to any principles of conflicts of law.
  • Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms, including its existence, validity, or termination, shall be referred to and finally resolved by arbitration or the designated courts within the primary operating jurisdiction of AirPay, ensuring an efficient legal resolution for both domestic and global merchants.
